Mexico Employment Law Update: Reform on the increase of vacation days

On December 27, 2022, the decree amending articles 76 and 78 of the Federal Labor Law on vacations was published in the Official Gazette of the Federation.

Below you will find a summary of the main points.

  • It is approved to increase the vacation days from the first year of service to 12 days, which will increase by two working days for each year of service until reaching 20 in the fifth year, being as shown in the following table:

  • Beginning with the sixth year of service, vacation days will increase by two days for every five years of service.
  • Workers shall have the right to enjoy at least 12 days of continuous vacation or to distribute them in the manner and time they wish.
  • The reform will enter into force on January 1, 2023.
